NOTICE OF OPPORTUNITY FOR COMMENT AND NOTICE OF OPPORTUNITY FOR HEARING

For telecommunications companies that currently have or intend to have an interconnection agreement(s) with Qwest Corporation (Qwest), Qwest offers its Statement of Generally Available Terms and Conditions for terms, conditions, and prices for interconnection, unbundled network elements, ancillary services, and resale services. As part of an interconnection agreement, competitive local exchange companies (CLECs) also have the option of a Performance Assurance Plan (PAP). The PAP provides for self-executing payments to CLECs if Qwest does not provide interconnection services to the CLEC at parity to the service it provides to its own retail customers, or if Qwest fails to meet certain service benchmarks.

PAP section 16.1 provides for a review of the PAP every six months. Participants of the review include Qwest, CLECs, and the Commission.

The purpose of the review is to determine whether performance measurements should be added to, deleted from, or modified in the PAP; whether the applicable benchmark standards should be modified or replaced by parity standards; and whether to move a classification of a measurement to High, Medium, or Low or Tier 1 to Tier 2.

On February 22, 2006 the Commission issued a Notice of 6-month Review, Notice of Opportunity for Comment, and Notice of Opportunity for Hearing indicating that proposed revisions to performance measurements that have been filed in Case Nos. PU-04-500, PU-04-632, PU-05-583 and proposed revisions to the PAP have been filed in Case Nos. PU-04-501, PU-04-631, and PU-05-584 would be included in the 6-month review.

On May 9, 2006 MCImetro Access Transmission Services LLC (MCImetro) filed a Petition to Intervene and filed comments in the proceeding. MCImetro’s comments supported approval and adoption of the revisions to performance measurements and revisions to the PAP subject to this proceeding. On May 24, 2006 the Commission granted the petition of MCImetro to intervene.

On July 27, 2005 the Commission opened a proceeding to join in a multi-state audit of Qwest’s PAP, Case No. PU-05-399. The multi-state audit was organized by the Qwest Regional Oversight Committee (ROC). The Liberty Consulting Group (Liberty) was chosen to audit Qwest’s wholesale performance remedy payments and the results of certain Qwest wholesale performance measures for the year 2004 for 13 states in the region served by Qwest. Liberty was directed to verify the accuracy of 2004 Qwest PAP payments to CLECs and the states participating in the audit, and verify the performance results for selected measures. The Commission has received a copy of Liberty’s October 28, 2005 final report. The report lists 21 findings for North Dakota that may have affected Qwest’s reported performance results or payments under the PAP.

The Commission intends to incorporate by reference Case No. PU-05-399 into this proceeding and now issues a Notice of Opportunity for Comment and Notice of Opportunity for Hearing concerning the findings of the Liberty audit. Comments, requests for hearing, and requests for intervention must be filed by August 31, 2006.

Comments should address the following issues:

1. Whether there exists an omission or failure of existing performance measures to capture intended performance.

2. Whether there is duplication of another performance measurement.

3. Whether such omission, failure, or duplication of a performance measure justifies the addition, modification, or removal of a performance measure.

4. Whether any benchmark standards should be modified or replaced by parity standards.

5. Whether the actual volume of data points have been less or greater than anticipated and, if so, whether there is justification for the reclassification of a performance measurement.

Any disputes regarding adding, deleting, or modifying performance measurements shall be resolved by the Commission. Any changes at the 6-month review under PAP section 16.1 shall apply to and modify interconnection agreements between Qwest and CLECs that have incorporated the PAP.

Mauch appointed Connell as temporary chairman.

Connell called for nominations for President of the School Board for the 2006-2007 school year.

Mauch was nominated. Connell called three more times for nominations. Thomas motioned for nominations to cease and a unanimous vote be cast for Mauch as School Board President. Motion carried 7-0.

Mauch called for nominations for Vice President of the School Board. Buck nominated Merbach with Tedrow seconding. Steiner nominated Buck with Thomas seconding. Merbach was elected Vice President by a 5-2 vote.

To designate depositories for school funds at Bank of the West, Wells Fargo Bank, Bremer Bank- Econofoods, US Bank, Gate City Federal Bank, American Federal Bank and First Community Credit Union.

To designate Smith, Strege and Fredericksen Law Firm as the School Attorney at $160 per hour. The firm is a member of the North Dakota School Attorneys Association.

To authorize the Business Manager and President to sign warrants.

To set the second Wednesday of each month at 7:00 p.m. as the School Board Monthly meeting times, with the exception of June 6th at 7:00 p.m. due to the Annual School Board Election.

To set the official school newspaper as the Wahpeton Daily News.

    PUBLIC NOTICE

    At the regularly scheduled meeting of the city of Tenney, did pass by unaminous decision the following ordinance.

    Ordinance No. 13

    An ordinance establishing zoning requirements regulating construction and location residential dwellings, apartment complexes, retail or commercial stores and industrial facilities, for the purpose of providing for light, air, and privacy and safeguarding the public welfare by preventing visual obstructions at street and highway intersections. Pursuant to section 462.354 of the Minnesota Statutes, a permanent planning and zoning commission is established for the City of Tenney; the common council of the city of Tenney does hereby ordain as follows:

    Section I. The commission shall consist of four members, all residents of the city. All member of the commission shall be appointed by the Mayor with the advice and consent of the council, and shall serve without compensation. Each member of the commission shall be appointed for a term of four years. Vacancies occurring on the commission shall be filled for the unexpired term by an appointment by the Mayor with the advice and consent of the council. The members of the commission shall organize by electing from their members a Chair, a Vice Chair and Secretary.

    Section II. The commission shall hold a regular annual meeting on the second Monday of January of each year The Chair or any two members of the commission may call special meetings of the commission at any time by giving notice thereof, in any manner, to the members at any time before the hour called. The failure to notify any member who is absent from the city or is from disability unable to receive notice, shall in no way invalidate the proceedings at such special meeting if a quorum of three members is present. Each member of the commission, including the Chair and Vice Chair, shall have one vote on all matters acted upon by the commission. The commission shall adopt a set of rules to govern its own meetings and procedures, which rules shall not be inconsistent with the provisions of the city ordinances and this code. The rules may be amended from time to time but only upon notice to all members that proposed amendments shall be acted upon at a specified meeting.

    Section III. The planning and zoning commission is charged with the duty of formulating, preparing and proposing for adoption, plans, programs and policies relative to the present or future physical development and planning of the city and relative to any other planning and development activities authorized by Minnesota Statutes. From time to time, the planning and zoning commission shall revise a comprehensive plan covering all matters, including zoning, essential to the orderly development and physical improvement of the city, and shall submit the same to the council for its consideration as developments or changes indicate. The council shall refer to the planning and zoning commission all petitions for annexations, all petitions for zone changes, all plats and replats of land in the city, all petitions for the vacating of streets and alleys, and other related planning matters. The planning and zoning commission shall coordinate with all of the city boards and departments and other governmental agencies and private utilities with respect to needs for public lands, easements and streets and coordinate other planning and zoning matters before making a recommendation to the council. The function of the commission shall be advisory only, except in those instances where it is given specific authority to act by the council.

    Section IV Procedure in Filing Plats, etc. All applications or petitions for plat and replat approval, annexations, zone changes, vacating of streets, alleys or other public grounds, and all applications or petitions relating to other planning matters, shall be filed in duplicate in the office of the city clerk together with all supporting data and information required by state law or ordinance of the city. Upon the filing of any such application or petition, the city clerk shall submit the original to the council at its next regular meeting, but the city clerk shall submit the original to the council at its next regular meeting, but the city clerk shall immediately forward the duplicate copy of the same together with the supporting data and information to the planning and zoning commission for processing, review and recommendation. To allow adequate time for processing, and application or petition must be filed with the city clerk at least 16 days before the meeting of the planning and zoning commission at which such application or petition shall be considered.

    Section V. If joint sessions and conferences between the planning and zoning commission and the Wilkin county planning commission are possible, it is the wish of the council that both commissions meet in joint session and thereby create and establish an informal city-county planning body with power to elect officers, appoint committees and make such proposals and present such plans as may be of common interest and mutual benefit to both the city and county. Both commissions, sitting in common session, acting wholly in an advisory and proposing capacity, shall, from such joint sessions, carry such proposals as may be made, and which affect directly either municipal or county development, or both, to their respective governmental bodies and agencies for final acceptance or rejection.

    Section VI. This ordinance shall take effect and be in force from and after its passage and after its publication.

    The Board of Managers, Buffalo-Red River Watershed District, has scheduled a public hearing on the 2007 general budget, and the levies for the ditch systems and projects under their jurisdiction for Monday, September 11, 2006, at 9:00 PM in the Watershed District office, 123 Front Street, Barnesville, Minnesota.

    A summary of the proposed budget is as follows:

    1. Administrative Funds. An amount not to exceed Two Hundred Fifty Thousand and No/100 Dollars ($250,000) for engineering, legal, clerical, office, and other administrative expenses, per M. S. A. 103D.905, Subd. 3.

    2. Basic Water Management. In accordance with M.S.A. 103D.905, Subd. 3, and as amended by the 2006 Legislature, an amount not to exceed 0.02394 percent of the taxable market value to pay the costs attributable to the basic water management features of projects/programs implemented by petition, including One Hundred Thousand and No/100 Dollars ($100,000) to finance Project No. 54, Whisky Creek Tributaries Water Resource Management; Twenty-five Thousand and No/100 Dollars ($25,000) for the Red River Basin Commission (RRBC); and Forty Thousand and No/100 Dollars ($40,000) for River Keepers.

    NOTICE OF PUBLIC

    HEARING

    The City of Wahpeton will hold a public hearing on September 5, 2006 at 5:00 p.m. at the Wahpeton City Hall to receive comments and respond to questions concerning the City’s Community Development Block Grant for the Imation Corp. Expansion Project. The project was funded with fiscal year 2001 funds in the amount of $1 million. Funds were used for building construction, infrastructure and site work, engineering and administrative costs. Prior to closeout of the project, the City of Wahpeton will provide this opportunity for the public to assess the city’s performance in carrying out its community development responsibilities accompanying the use of HUD funds for the project.

    Both oral and written comments will be accepted. Written comments must be received by 5:00 p.m. on September 5, 2006 at the office of the City Administrator, P.O. Box 490, Wahpeton, ND 58074. Written summary information regarding the project will be available at the Auditor’s Office until 5:00 p.m. on September 5, 2006.

    The Bois de Sioux Watershed District Rules and Regulations require that a permit be obtained PRIOR to doing any work within the District, including but not limited to the following:

    2. Constructing new or improving existing drainage systems including surface ditches and tiling on public or private lands.

    3. Construction, alteration, or removal of any dike or dam including approaches or crossings without culverts through them.

    5. Landforming (reshaping of the surface topography not including landleveling).

    6. Draining of wetland types 3, 4, 5, & 8 as described by Circular 39, Wetlands of the United States, Published by the US Dept. of Interior.

    7. Installation, alteration, or removal of any drainage structure (including but not limited to culverts, bridges, tiles, weirs, stop log bays, screw gates, etc.)

    8. Changes made in the bed, banks or shores of natural drainageways, lakes or wetlands.

    NOTICE TO VOTERS OF BRANDENBURG TOWNSHIP RICHLAND COUNTY, NORTH DAKOTA OF SPECIAL MEETING AND ELECTION TO AUTHORIZE EXCESS TAX LEVY

    Notice is hereby given that the governing body of Brandenburg Township, Richland County, North Dakota has declared by resolution, that the amount of taxes which may be raised at the maximum rate authorized by Chapter 57-15 of the North Dakota Century Code is inadequate for the necessary requirements of the township and that it is necessary to levy taxes in excess of said limitation for the purpose of meeting current expenses. The issue of approval or rejection of a five mill excess levy for tax years 2006, 2007, 2008, 2009 and 2010 will be presented to the voters at a special meeting called for that purpose on September 18, 2006 at the Great Bend, North Dakota Firehall at 8:00 o’clock P.M., the total amount of income for the year 2005 was $22,045.15, the total expenditures for the year 2005 were $25,106.10. The estimated expenditures for each of the years for which the excess levies sought are $23,100.00. The aggregate amount of the tax levy which the board seeks authority to make for each year is $23,100.00. The aggregate amount of tax levy permissible without special authority from the electors for each year is $16,632.00. The amount of tax levy in excess of the statutory limit which the board seeks authority to make for each year is $6,468.00. Total revenue as stated above includes revenue from all sources and not only revenue from the current year’s tax levy.
