ON PROPOSED DEVELOPMENT AGREEMENT
The Wahpeton City Council will hold a public hearing on a proposed Development Agreement to implement an approved development plan within the city’s Tax Increment Financing District 2006-1. The purpose of the hearing is to provide potential competitors with an opportunity to comment on whether this agreement would result in unfair competition. The hearing will be at 5:00 o’clock p.m. on Monday, July 20, 2009 in the Wahpeton City Council Chambers at City Hall, 1900 Fourth Street North, Wahpeton, North Dakota. The proposed agreement is with Westgate Investments, LLC for the construction of a bank building to be located at Lot Two (2), Block One (1) Westgate Commons First Addition, in the City of Wahpeton, Richland County, North Dakota also known as a tract of land in a portion of Lot 1-C, Block 1 of Valley 1st Addition to the City of Wahpeton, as recorded at the Richland County Recorder, North Dakota, described as follows: Commencing at the Northwest corner of Lot 1-C, Block 1 of Valley 1st Addition; thence South 11º25’05” West along the chord of a curve to the left, which has a radius of 2,192.00 feet, a distance of 60.00 feet to a point that is on the Southeast Right-of-Way of Two Ten Drive; thence North 78º53’51” West a distance of 35.00 feet to a point on the Southeast right-of-way of State Highway 210 and the point of beginning; thence South 08º02’31” West along the chord of a curve to the left, which has a radius of 2,192.00 feet a distance of 200 feet to a point on the Southeast right-of-way of State Highway 210; thence North 88º07’22” East a distance of 279.61 feet; thence North 09º55’05” West a distance of 140.47 feet; thence North 80º04’54” West a distance of 273.21 feet; to the point of beginning, the above described tract contains 45,066 square feet.
Public monies in the form of tax abatement will be considered for the construction of improvements including streets, roadways, appurtenances, storm water detention facilities, lighting, water mains, sewer mains, traffic control devices and administrative costs.

The State Board of Equalization will meet at 8:30 a.m., Tuesday, August 11, 2009 in the Brynhild Hauglen Room on the ground floor of the State Capitol, Bismarck, North Dakota, to consider the application of Swanson Health Products Inc. for exemption from state tax on the income earned in the operation of a project located in Fargo, North Dakota that will market vitamin supplements throughout the USA. Any competitor of the applicant may appear and be heard by the State Board of Equalization. Written comments may be addressed to: State Board of Equalization, Office of State Tax Commissioner, 600 East Boulevard Ave., Bismarck, ND 58505-0599.
