YOU ARE HEREBY SUMMONED and required to serve upon plaintiff’s attorney, within 20 days after service of this Summons for, exclusive of the date of service, an Answer to the attached Complaint of the plaintiff, which Complaint is on file in the Office of the above-named Court, which Complaint is herewith served upon you in accordance with the Rules of Civil Procedure of the State of Minnesota.
That the Administrator of the Small Business Administration, n/k/a U.S. Small Business Administration is summoned and required to serve upon plaintiff’s attorney, within 60 days after service of this Summons for, exclusive of the date of service, an Answer to the attached Complaint of the plaintiff, which Complaint is on file in the Office of the above-named Court, which Complaint is herewith served upon you in accordance with the Rules of Civil Procedure of the State of Minnesota.
NOTICE OF ALTERNATIVE DISPUTE RESOLUTION
Parties to a lawsuit are encouraged to attempt alternative dispute resolution pursuant to Minnesota law. Alternative dispute resolution includes mediation, arbitration, and other processes set forth in the district court rules. You may contact the court administrator about resources in your area. If you cannot pay for mediation or alternative dispute resolution, in some counties, assistance may be available to you through a nonprofit provider or a court program.
The object of this action is to effect a foreclosure by action of the referenced property. If you fail to answer the Complaint within the time aforesaid, judgment by default will be taken against you for the relief demanded in said Complaint, together with plaintiff’s costs and disbursements. No personal claim has been made against any defendant.
This action involves, effects or brings into question real property situated in the County of Wilkin, State of Minnesota and legally described as follows:
That part of the Southeast Quarter of the Northeast Quarter (SE 1/2 NE 1/4) of Section 28, Township 134 North, Range 45 West of the Fifth principal Meridian, Akron Township, Wilkin County, Minnesota described as follows: Commencing at an Iron Monument at the Southeast Corner of said Section 28, Thence measuring North 0 degrees 45 minutes East and running along the East line of said Section 28 to the Southeast corner of the Northeast Quarter (NE 1/4) of Section 28, a distance of 2651.9 feet, this beginning the Point of beginning of the tract hereby surveyed. Thence from said point of beginning continue North 0 degrees 45 minutes East and running along the East line of said Section 28 a distance of 600 feet. Thence measuring North 89 degrees 12 minutes West and running parallel to the South line of the Northeast Quarter (NE 1/4) of said Section 28 a distance of 400.00 feet. Thence measuring South 0 degrees 45 minutes West and running parallel to the East line of the Northeast Quarter (NE 1/4) of said Section 28 a distance of 600 feet. Thence measuring South 89 degrees 12 minutes East and running along the South line of the Northeast Quarter (NE 1/4) of said Section 28 a distance of 400 feet to the Point of Beginning and there terminating.
IF PART OF THE PROPERTY TO BE SOLD CONTAINS YOUR HOUSE, YOU MAY DESIGNATE AN AREA AS A HOMESTEAD TO BE SOLD AND REDEEMED SEPARATELY.
YOU MAY DESIGNATE THE HOUSE YOU OCCUPY AND ANY AMOUNT OF THE PROPERTY AS A HOMESTEAD. THE DESIGNATED HOMESTEAD PROPERTY MUST CONFORM TO THE LOCAL ZONING ORDINANCES AND BE COMPACT SO THAT IT DOES NOT UNREASONABLY REDUCE THE VALUE OF THE REMAINING PROPERTY.
YOU MUST PROVIDE THE COURT WITH A LEGAL DESCRIPTION OF THE HOMESTEAD YOU HAVE DESIGNATED.

Notice is hereby given that sealed bids will be received for the North Central Area Streets Rehabilitation; Street Improvement District 10-10-14; City Project No. ST10-16 to consist of pavement removal, bituminous pavement replacement, milling, bituminous overlay, seal coat, remove and replace concrete curb and gutter, ADA sidewalk ramps, and all miscellaneous work necessary therefore and incidental thereto.
Bids will be received by Darcie Huwe at the office of the Finance Director; 1900 4th Street North; Wahpeton, ND 58075 until 1:00 PM, CST (Central Standard Time) Monday March 1, 2010, and then at said office publicly opened and read aloud.

Each bid will be submitted on the basis of a cash payment for work. It will be enclosed in a sealed envelope addressed to the above mentioned City Auditor, and shall be accompanied by a separate envelope containing a Bidder’s Bond in the amount of five (5%) of the bid, executed by the Bidder as Principal and by a Surety Company authorized to do business in this State. If the Principal’s Bid is accepted by the City and the contract awarded to him, he, within ten (10) days after the Notice of Award, will execute and effect a contract in accordance with the terms of his bid.
A Contractor's Bond as required by Chapter 48 01.2-10 of the North Dakota Century Code will be included with the executed Contract Documents. The Bid Security shall be as required in Section 48-01.2 05 of the North Dakota Century Code.
All bidders must be licensed for the highest amount of their bids, as provided by Section 43 07 05 of the North Dakota Century Code and a copy of the license or certificate of renewal thereof issued shall be enclosed in the required bid bond envelope.
No bid will be read or considered which does not fully comply with the above provisions as to Bond and Licenses, and any deficient bid submitted will be resealed and returned to the Bidder immediately.
The OWNER retains the right to reject any or all of the bids submitted and to waive any informality in any bid and to hold all bids for period not to exceed thirty (30) days and to hold the three low bids and bid securities for a period not to exceed sixty (60) days from the date of bid opening.
The work on the improvements is to commence upon a date to be specified by the City Council, notice of which will be given to the successful bidder fifteen (15) days in advance of start of construction. Construction for the Seal Coat shall be completed by September 1, 2010. The total project shall be completed by October 15, 2010.
