NOTICE OF MORTGAGE FORECLOSURE SALE

YOU ARE NOTIFIED THAT:

1. Default has occurred in the conditions of the Mortgage dated May 8, 2006, executed by Jeffrey Todd Germundson, unmarried, as Mortgagor, to Wells Fargo Financial North Dakota, as Mortgagee, and filed for record May 22, 2006, as Document No. 187372, in the office of the County Recorder of Wilkin County, Minnesota. The land described in the Mortgage is not registered land.

2. The original principal amount secured by the Mortgage was $48,019.00.

3. No action or proceeding at law is now pending to recover the debt secured by the Mortgage, or any part thereof.

4. The holder of the Mortgage has complied with all conditions precedent to acceleration of the debt secured by the Mortgage and foreclosure of the Mortgage, and all notice and other requirements of applicable statutes.

5. At the date of this notice the amount due on the Mortgage, and taxes, if any, paid by the holder of the Mortgage is $53,150.74.

6. Pursuant to the power of sale in the Mortgage, the Mortgage will be foreclosed, and the land described as follows:

7. The mortgagor must vacate the property on or before 11:59 p.m. September 27, 2010, if the mortgage is not reinstated under Minn. Stat. Sec. 580.30 or the property is not redeemed under Minn. Stat. Sec. 580.23, or if the redemption period is not reduced under Minn. Stat. Sec. 582.032.

8. The time allowed by law for redemption by Mortgagor or Mortgagor’s personal representatives or assigns is 6 months after the date of sale.

9. THE TIME ALLOWED BY LAW FOR REDEMPTION BY THE MORTGAGOR, THE MORTGAGOR’S PERSONAL REPRESENTATIVES OR ASSIGNS MAY BE REDUCED TO FIVE WEEKS IF A JUDICIAL ORDER IS ENTERED UNDER MINNESOTA STATUTES, SECTION 582.032, DETERMINING, AMONG OTHER THINGS, THAT THE MORTGAGED PREMISES ARE IMPROVED WITH A RESIDENTIAL DWELLING OF LESS THAN FIVE UNITS, ARE NOT PROPERTY USED IN AGRICULTURAL PRODUCTION, AND ARE ABANDONED.

10. THE RIGHT TO VERIFICATION OF THE DEBT AND IDENTITY OF THE ORIGINAL CREDITOR WITHIN THE TIME PROVIDED BY LAW IS NOT AFFECTED BY THIS ACTION. THIS IS AN ATTEMPT TO COLLECT A DEBT. ANY INFORMATION OBTAINED WILL BE USED FOR THAT PURPOSE.

THE STATE OF NORTH DAKOTA TO THE ABOVE-NAMED DEFENDANT:

You are hereby summoned and required to appear and defend against the Complaint in this action, which is herewith served upon you, by serving upon the undersigned an Answer or other proper response within twenty (20) days after the service of this Summons upon you exclusive of the day of service. If you fail to do so, judgment by default will be taken against you for the relief demanded in the Complaint.

NOTICE OF TEMPORARY RESTRAINING PROVISIONS

Under Rule 8.4 of the North Dakota Rules of Court, upon service of this Summons, you, and your spouse, are bound by the restraints following: (a.) Restraining provisions. A summons in a divorce or separation action must be issued by the clerk under the seal of the court, or by an attorney for a party to the action, and include the following restraining provisions: (1) Neither spouse shall dispose of, sell, encumber, or otherwise dissipate any of the parties’ assets, except: a. For necessities of life or for the necessary generation of income or preservation of assets; or b. For retaining counsel to carry on or to contest the proceeding; if a spouse disposes of, sells, encumbers, or otherwise dissipates assets during the interim period, that spouse shall provide to the other spouse an accounting within 30 days. (2) Neither spouse shall harass the other spouse. (3) All currently available insurance coverage must be maintained and continued without change in coverage or beneficiary designation. (4) Neither spouse shall remove any of their minor children from North Dakota without the written consent of the other spouse or order of the court except for temporary periods.
