Oscar Eladio Zubiate Jr., 29, Wahpeton, made his initial appearance in Wahpeton Municipal Court Friday, Oct. 26.
Zubiate Jr. is accused of two counts of indecent exposure following incidents at Econofoods and Walmart in Wahpeton.
“We were able to get an accurate description of both the suspect and the car he was driving,” Wahpeton Police Chief Scott Thorsteinson said. “He was arrested at home, held overnight and brought before municipal court.”
Eyewitnesses say a man wearing only shoes and a hat was shopping for produce around 5 p.m. Thursday, Oct. 25 at Walmart. The same man, believed to be Zubiate Jr., was also previously seen in Econofoods. Zubiate Jr. was in court the next day for a 1 p.m. bond appearance.
The Wahpeton incidents are not currently listed in Richland County, North Dakota, court records. Zubiate Jr. has no other previous felony or misdemeanor charges listed.
Indecent exposure, a class B misdemeanor, has a maximum penalty of a $1,500 fine, 30 days in jail, or both.
“In his case, it’s times two,” Thorsteinson said.
