A Minnesota man was charged in Wilkin County with felony counts relating to sexual misconduct against a mentally impaired individual relating to an incident occurring in April in Breckenridge, Minnesota. He is also facing two felony drug charges and several misdemeanor charges.
Kelly Benjamin Birch, 51, of Elizabeth, Minnesota, was arrested April 9.
The felony counts against him are fourth degree criminal sexual conduct with a mentally impaired victim, fourth degree criminal sexual conduct with a victim aged 16-17, storing meth paraphernalia in the presence of a child or vulnerable adult and fifth degree drug possession/not small amount of marijuana, according to a criminal complaint.
Birch also faces two gross misdemeanor counts of neglect of a child and fifth degree criminal non-consensual sex contact.
He is also charged one misdemeanor and two petty misdemeanors. The misdemeanor is indecent exposure engaging in lewd or indecent behavior and the petty misdemeanors include possession of a small amount of marijuana and possession of drug paraphernalia.
The incident occurred at Select Inn in Breckenridge. Multiple people witnessed the alleged misconduct and notified law enforcement. The victim is someone known to Birch, according to the criminal complaint.
An omnibus hearing is scheduled for Tuesday, July 9 in Wilkin County District Court.
